| December 19, 2006 I want to thank the San Diego Men's Center for all the outstanding work it does. I have seen the Center grow from a mere idea with a simple philosophy to a full-blown center that is helping scores of men, women, children, and families in need. The Center is truly historical and badly needed. I am proud to work with the Center and will continue to support it in any way I can. Marc E. Angelucci, Esq. The NCO's (no contact orders) currently do not mandate that the person requesting the NCO abide by any of the rules that bind the person the order was taken against. In my case my ex actually called the Sheriff's dept. and claimed I had attempted to contact her by phone. When the officer, bright guy and not lazy, asked to see her cell phone so he could verify the call he found NO ONE had called her at the time she claimed I had called and he could not find evidence that I had ever called. This officer contacted me and told me what had transpired. I showed him where SHE had attempted to contact me. Her number was in my incoming/missed call log. Her attempts, both the claimed call and the calls she made to my phone, were to make it appear I had violated the NCO. If she had been held to the same standard of conduct as I as regards the NCO she would have to face the judge and could be arrested (if not jailed, emphasis ours). The current laws do not provide punitive measures against those persons that obtain a NCO and then make every attempt to get the party arrested for non-compliance with the NCO." (Or, there are no provisions to hold accountable those who willfully manipulate the NCO's she/he were granted to maliciously entrap the target(s) of the NCO's). JR - January 2007 Just so you know, generally, law enforcement discourages the use of mutual restraining orders. Why? When only one party is restrained the police know who to arrest; that is, they arrest the person restrained regardless of who initiated the violation of the order. |
